It is not a legal service, HR advisory service, mental health service, or therapy platform. Nothing in this application constitutes legal advice, HR advice, medical advice, or professional counsel of any kind.

By using Off Record, you acknowledge and agree that:

All content generated by Off Record is for informational and reflective purposes only
Off Record does not create any professional, fiduciary, or advisory relationship between you and Off Record or its operators
You are solely responsible for any decisions or actions you take based on content generated by this service
Off Record expressly disclaims all liability for outcomes resulting from your use of or reliance on any content generated by this service

2. Information We Collect

2a. Information You Provide Directly

Account information (if you sign in with Google):

Name
Email address
Profile image
Google account identifier

Conversation content:

Messages you submit during conversations
Workplace situations and context you describe
Responses generated by the AI system

Payment information (if you subscribe):

Billing details are processed by Stripe, Inc. We do not store your full payment card details. We receive and store subscription status, plan type, and Stripe customer identifiers.

We do not intentionally collect:

Sensitive personal categories such as health or medical information, racial or ethnic origin, religious beliefs, sexual orientation, or biometric data
Information about third parties you mention in conversations beyond what is necessary to provide the service

3. How We Use Your Information

We use your information to:

Provide, operate, and maintain the Off Record service
Process payments and manage subscriptions
Improve AI response quality and service functionality
Maintain security, prevent fraud, and enforce our terms
Communicate service updates and account information
Comply with legal obligations

We do not use your conversation content to train third-party AI models without your explicit consent.

4. How We Store Your Information

Your data is stored using the following third-party infrastructure:

Supabase — database and authentication infrastructure
Vercel — application hosting and deployment
Anthropic — AI model provider (conversation content is processed by Anthropic's API in accordance with their privacy policy and data handling terms)
Stripe — payment processing
OpenRouter (if applicable) — AI routing infrastructure

Data may be stored on servers located in the United States. If you are located outside the United States, your information may be transferred to and processed in the United States, which may have different data protection laws than your country of residence.

5. Data Retention

We retain your data for as long as your account is active or as needed to provide the service.

Conversation data is retained to enable the service to function across sessions, including maintaining conversation history and fact logs that improve response quality.

You may request deletion of your data at any time by contacting getoffrecord@gmail.com. We will process deletion requests within 30 days. Some information may be retained for legal, compliance, or fraud prevention purposes after account deletion.

6. Data Sharing

We do not sell your personal information.

We share information only in the following circumstances:

Service providers: We share information with third-party providers who help us operate the service (listed in Section 4). These providers are contractually required to protect your information and use it only for the purposes we specify.

Legal requirements: We may disclose information if required by law, court order, or governmental authority, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

Business transfers: If Off Record is acquired, merged, or its assets are transferred, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

Crisis situations: If you communicate information that suggests imminent risk of harm to yourself or others, we may share information with emergency services or appropriate authorities where we believe it is necessary to prevent serious harm.

7. AI-Generated Content — Disclaimer of Liability

Off Record uses artificial intelligence to generate responses to your workplace questions. You expressly acknowledge and agree to the following:

Not professional advice. Content generated by Off Record does not constitute and should not be relied upon as legal advice, HR advice, employment advice, medical advice, psychological advice, financial advice, or any other form of professional advice. No attorney-client, therapist-client, or other professional relationship is created by your use of this service.

No warranty. AI-generated content may be inaccurate, incomplete, outdated, or inappropriate for your specific situation. We make no representations or warranties regarding the accuracy, completeness, reliability, suitability, or availability of any content generated by this service.

Your responsibility. All decisions and actions you take in response to content generated by Off Record are solely your responsibility. Off Record and its operators expressly disclaim all liability for any outcomes, losses, damages, or consequences — direct, indirect, incidental, or consequential — arising from your use of or reliance on content generated by this service.

Limitation of liability. To the fullest extent permitted by applicable law, Off Record's total liability to you for any claims arising from your use of this service shall not exceed the amount you paid to Off Record in the twelve months preceding the claim, or $100, whichever is less.

Indemnification. You agree to indemnify and hold harmless Off Record and its operators from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service or your violation of these terms.

8. Mental Health and Crisis Disclaimer

Off Record is not a mental health service and is not equipped to provide crisis support, mental health counseling, or emergency intervention.

9. Your Rights

Depending on your location, you may have the following rights regarding your personal information:

Access — request a copy of the information we hold about you
Correction — request correction of inaccurate information
Deletion — request deletion of your information
Portability — request your data in a portable format
Objection — object to certain processing of your information

California residents: You may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to opt out of sale (we do not sell personal information), and the right to non-discrimination for exercising your rights.

EEA/UK residents: If you are located in the European Economic Area or United Kingdom, you may have rights under the General Data Protection Regulation (GDPR) or UK GDPR. Our legal basis for processing your information is your consent (for optional features) and our legitimate interest in providing and improving the service. 10. Cookies and Tracking

We use cookies and similar technologies to maintain your session, authenticate your account, and understand how the service is used. You can control cookie settings through your browser, but disabling cookies may affect service functionality.

11. Children's Privacy

Off Record is not intended for users under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected information from a child under 16, we will delete it promptly. 12. Security

We implement reasonable technical and organizational measures to protect your information, including encrypted data transmission (TLS), access controls, and secure infrastructure providers.

However, no online service can guarantee complete security. You use Off Record at your own risk. We are not responsible for unauthorized access to your information resulting from circumstances beyond our reasonable control.

13. Changes to This Policy

We may update this Privacy Policy as the service evolves. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification to your registered address.

Your continued use of Off Record after changes are posted constitutes your acceptance of the updated policy.
